Leander Council votes to settle lawsuit with former City Manager

The Leander City Council voted unanimously to agree to a settlement agreement with former Leander City Manager Kent Cagle over his lawsuit alleging he was unlawfully terminated for reporting a city official to law enforcement.

Details about what the settlement will entail is pending further information from the City of Leander. Hill Country News will update this story when more information becomes available. 

Cagle filed a lawsuit against the city on  Aug. 9 in Travis County District Court is seeking more than  $1 million and citing breach of contract for the city's failure to pay his severance after the council voted May 20 to terminate his employment and along with claiming unlawful retaliation under the Texas Whistleblower Act.

He is also seeking several other costs in the lawsuit, including payment to cover contractual damages, attorneys’ fees and court costs.

The lawsuit is also seeking to have a judge issue a declaration that the city violated Cagle’s rights under Texas code and “engaged in unlawful employment discrimination, and considered an illegal factor in terminating Plaintiff’s employment.”

In a written response to the Hill Country News about the allegations, Leander Public Information Office Mike Neu shared the following statement:

"The city denies any wrongdoing in the handling of Mr. Cagle’s employment and the related claims in his lawsuit. While we cannot comment on specific personnel issues or ongoing litigation, the city carefully considered the decision to separate Mr. Cagle — it was based on employment-related factors and not retaliatory in any way."

The Leander City Council voted on May 20 to terminate Cagle. The cause of the termination was unclear at the time and neither the city nor the city council has given an explanation, though Hill posted on social media that the "Council felt we needed a new direction."

That post has since been deleted.
